These terms explain the rules for using the Awake Link app. Part 1 covers your account, your Awake products and how we run the App. Part 2, the Community Guidelines, covers what you share with other riders. Together they form one agreement between you and Ride Awake ApS.

 


 

Part 1: Terms of Use

1. Who we are and what these terms cover

Awake Link (the App) is the companion app for Awake products. It is provided by Ride Awake ApS, Langebrogade 3B, 1411 Copenhagen, Denmark, CVR 45071820 (Awake, we, us).

By creating an account or using the App, you agree to these terms. The following also apply:

  • our Privacy Policy (awakeboards.com/pages/privacy-policy), which explains how we handle your personal data;

  • our Terms of Sale (awakeboards.com/pages/terms), which apply when you buy Awake products;

  • the terms of the app store you downloaded the App from.

2. Your account

  • Age. You must be at least 16 to create an account and use the community features on your own. If you're under 16, you may use the App only with the consent and supervision of a parent or legal guardian, and you may not use the community features.

  • Your details. Give accurate information and keep your login details safe. You're responsible for what happens on your account. If you think someone else has used it, tell us at support@awakeboards.com.

  • Your username. Your username is public. It must not be offensive or misleading, or imitate another person or brand. We may change a username that breaks these terms, and we'll tell you why.

  • Your account is personal. You can't sell it or transfer it to someone else.

3. Your Awake products and safety

  • What the App does. The App connects to your Awake board, battery and hand controller over Bluetooth. With it you can:

    • register your gear;

    • install firmware updates;

    • check battery and product status;

    • record and review your rides;

    • find guides and support.

  • The App doesn't replace safety instructions. Riding an electric surfboard or eFoil carries a risk of serious injury. Always follow the user manual, the safety instructions and any training you've received. Follow local rules wherever you ride.

  • Information is approximate. Ride data, battery levels, range estimates and maps in the App are approximate. Don't rely on them for decisions that affect your safety.

  • Firmware updates. Install updates when the App recommends them. Keep the App connected until the update finishes, and never ride during an update.

  • Registration and ownership.

    • Only register products you own or are allowed to use.

    • Some Awake batteries have anti-theft protection linked to the owner's account. Don't try to get around it.

    • If you sell or give away a product, remove it from your account in the App first, so the new owner can register it.

  • Rented products. If you ride a rented Awake product, the rental provider's terms and instructions also apply.

4. Community features

  • Community features are optional; you turn them on in the App. They include your profile, posts, shared rides, ride spots, likes and follows.

  • You choose who sees your rides, posts and spots in the App's visibility settings.

  • Everything you share must follow the Community Guidelines in Part 2. We have zero tolerance for objectionable content and abusive users.

5. Your content

  • You keep ownership. The photos, text, rides and ride spots you share (your content) stay yours.

  • What you allow us to do.

    • So that we can run the App, you give us a worldwide, non-exclusive, royalty-free licence to host, store, copy, adapt (for example resize), display and distribute your content.

    • We use it only within the App, only for the audience your settings allow, and only to operate, secure, moderate and improve the App.

    • Our service providers may do this for us.

    • The licence ends when you delete the content or your account. The exceptions are backup copies kept for a short time, and content we must keep by law or to handle a dispute.

  • No advertising without asking. We won't use your content in advertising or marketing outside the App without your permission.

  • Your responsibility. Only share content you have the right to share. Don't share photos or videos of other people without their permission.

6. Moderation

  • How we moderate. Uploaded photos are checked automatically, and an upload may be blocked. People on our team review every report and make every decision about accounts.

  • What we may do. If content or behaviour breaks these terms, the Community Guidelines or the law, we may:

    • remove the content or limit who can see it;

    • give you a warning;

    • suspend your account;

    • close your account permanently.

  • We act carefully and proportionately, with respect for everyone's rights, including freedom of expression.

  • We explain our decisions. If we act on your content or account, we tell you what we did, why, which rule it was based on, and how to appeal. We only skip this where the law prevents it.

  • Appeals. You can appeal within six months by replying to our message or emailing support@awakeboards.com. A person will review the decision again and tell you the result. You can also turn to the courts or the authorities.

  • Reporting. Anyone can report content they believe is illegal or breaks these terms: in the App with Report, or by email to support@awakeboards.com. We handle every report and tell the person who reported it what we decided.

7. What you must not do

  • Use the App to break the law or to harm others.

  • Use bots or scraping to access the App or its data, or collect other users' data.

  • Try to bypass security, access controls, speed limits, safety features or anti-theft protection.

  • Copy, modify or reverse engineer the App, except where the law allows it.

  • Disrupt the App, our servers or other users.

8. Third-party services

Some features come from other companies, and their terms apply when you use them:

  • maps from Mapbox (© Mapbox, © OpenStreetMap);

  • tutorial videos from YouTube, shown only after you agree;

  • sharing to apps such as Instagram.

9. Changes to the App

We keep improving the App, and may add, change or remove features. We work hard to keep it running, but we can't promise it will always be available or free of errors.

10. Ending your account

  • You can leave at any time. Delete your account in the App under Settings → Account → Delete account. Our Privacy Policy explains what happens to your data.

  • We may suspend or close your account. We may do this if you seriously or repeatedly break these terms, if the law requires it, or to protect other riders or our products. Where possible and lawful, we tell you first and explain why.

  • Your products are not affected. Closing your account doesn't change your ownership of your Awake products or your rights under the Terms of Sale and warranty.

11. Liability

  • The App is free.

  • As far as the law allows, we're not liable for indirect or consequential loss, or for content posted by other users.

  • Nothing in these terms limits liability that the law doesn't allow us to limit, such as for death or personal injury caused by negligence, or for fraud.

  • Nothing in these terms affects your rights as a consumer.

12. Changes to these terms

We may update these terms, for example when we add features or when the law changes. If a change is significant, we'll tell you in the App at least 30 days before it takes effect, unless it has to happen sooner for legal or safety reasons. If you don't agree, you can delete your account before the change takes effect.

13. Law and disputes

These terms are governed by Danish law. If you're a consumer, you also keep the protection of the mandatory laws of the country where you live, and you can take a dispute to the courts there.

15. If you downloaded the App from Apple's App Store

  • These terms are between you and Awake, not Apple. Awake, not Apple, is responsible for the App and its content.

  • Apple has no obligation to provide maintenance or support for the App.

  • If the App doesn't meet an applicable warranty, you can notify Apple, and Apple may refund the price you paid for the App, if any. Apple has no other warranty obligation for the App.

  • Awake, not Apple, is responsible for handling any claims about the App, including product liability, legal or regulatory compliance, consumer protection, and intellectual property claims.

  • You confirm that you're not located in a country subject to a US Government embargo, and that you're not on any US Government list of prohibited or restricted parties.

  • Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

 


 

Part 2: Community Guidelines

The Awake Link community is where riders share rides, ride spots, photos and stories from the water. We want it to feel like the best beach on a good day: friendly, safe and full of people who love riding. These guidelines apply to everything you share in the App: your profile, username, photos, posts, reshares, rides and ride spots.

We have zero tolerance for objectionable content and abusive users. If you break these guidelines, we may remove your content and suspend or permanently close your account.

1. Respect other riders

  • No harassment, bullying, threats or intimidation.

  • No hate. Don't attack or put down anyone for their race, ethnicity, nationality, religion, disability, sex, gender identity, sexual orientation or age.

  • Don't pretend to be someone else, including other riders, Awake staff, dealers, schools or athletes.

2. Keep it appropriate for everyone

  • No nudity, sexual content or sexualised images.

  • No graphic violence, gore or shocking images.

  • Never post anything that sexualises or endangers children. We remove it immediately, close the account and report it to the police.

3. Ride safely and legally

Electric surfboards and eFoils are fast and powerful. A board at speed, or an eFoil's wing and propeller, can seriously injure people. What you share influences how others ride.

  • Don't post or promote dangerous riding. That includes riding close to swimmers, divers, paddlers or boats; in swimming areas, harbours or shipping lanes; at night without proper lights; or under the influence of alcohol or drugs.

  • Don't share content showing or encouraging tampering with boards, batteries, chargers or firmware, or removing speed limits or safety features.

  • Follow local rules, permits, speed limits and protected-area restrictions.

  • Respect wildlife. Keep your distance from animals, nesting areas and nature reserves.

4. Share real, safe ride spots

  • Only add real places that riders can reach and ride legally.

  • Don't add spots on private property without the owner's permission, or where riding isn't allowed.

  • Mention known hazards, such as shallow water, rocks, currents or heavy boat traffic.

  • Don't add someone else's home, dock or private location as a spot.

5. Respect privacy, including your own

  • Only share photos or videos of other people when they've agreed.

  • Never share other people's personal information, such as addresses, phone numbers, private locations, licence plates or product serial numbers.

  • Think before you share your own. Rides you share with followers or the public show your full route, including where you start and finish. You choose who sees each ride.

6. Be genuine

  • No spam, scams, misleading content, fake accounts or fake likes and follows.

  • No advertising or selling without our permission. Dealers, schools and rental partners can contact us at support@awakeboards.com.

  • Never offer stolen equipment, and don't post battery or board serial numbers.

7. Respect the law and other people's rights

  • Only post content you made or have the right to share, including music, photos and videos.

  • Don't post anything illegal, or anything that promotes illegal activity.

How to report

  • In the App: tap Report on a post, profile, ride or ride spot. You can also block a rider. Blocked riders can't see your content, and you won't see theirs.

  • By email: if you don't use the App, or you want to report illegal content, email support@awakeboards.com. Tell us where the content is, what's wrong and, if you think it's illegal, why. Include your name and email so we can reply.

We don't tell the person you reported who reported them, unless the law requires it.

What happens next

  • Photos are checked automatically before they're published.

  • A person on our team reviews every report promptly.

  • Depending on how serious the case is and on your history, we may:

    • remove content or limit who can see it;

    • warn you;

    • suspend your account;

    • close your account permanently.

  • Serious cases lead to immediate removal. These include threats, sexual content involving children and severe harassment. We report threats to anyone's life or safety to the police.

  • If we act on your content or account, we tell you why and how to appeal. If you reported something, we tell you what we decided.

Appeals

If you think we got it wrong, reply to our message or email support@awakeboards.com within six months. A person will review the decision again and tell you the result.
