Application

These General Terms and Conditions of Sale (”Terms”, ”Terms and Conditions”, “Terms of Sale”) govern your relationship with Ride Awake ApS (”Awake”, ”us”, ”we”, or ”our”). Please read these Terms and Conditions carefully before using the Service. Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all users, buyers, partners, and others who access or use the Service. By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Service. They replace and cancel any previous general terms and conditions of sale appearing on any Awake document or agreed upon in any other manner. All sales are concluded subject to the condition precedent of the application of these unchanged General Terms and Conditions of Sale; thus, it is deemed that the customer has unconditionally accepted these terms and conditions.


The General Terms and Conditions of Sale shall prevail over those of the customer, notwithstanding any conflicting clauses provided for in the customer’s general terms and conditions and subject to any amendments which may be made to the General Terms and Conditions of Sale under the provision of this clause. Any contractual provision contrary to these terms and conditions must be proposed to Awake in writing, separately from the preprinted terms on the customer’s documents or from these printed General Terms and Conditions of Sale, and prior to Awake’s acceptance of an order. In order to be binding on Awake, the proposed modification must be expressly approved by Awake in writing and signed by Awake. The customer has by accepting these terms and conditions accepted that they must read, understand, and fully adhere to the User Manual and all its waivers and warnings before using the product.

Cancellation or Modification of Orders

All orders placed with Awake are firm and definitive. Exceptionally, they may be cancelled or modified at customer’s request, which is subject to Awake’s express consent. Elements that are (but are not limited to) taken into account are Force Majeure and extraordinary shipping situations. In case of modification: any modification may increase the cost of the order, which shall be notified to the customer for acceptance, and / or may cause delays for the respective order. In case of cancellation: all costs and expenses incurred by Awake until such cancellation and in relation to that order are to be borne by the customer.

Brochures & Technical Information

The information and characteristics presented in any catalogue, brochure, technical or specification sheets, assembly instructions or any other documentation are for information purposes only and shall, under no circumstances, be considered as firm offers. These documents are not legally binding. Awake reserves the right to carry out such modifications or improvements as it deems necessary on any products.

Orders, Payment & Pricing

  • Accepted payment methods are Visa, MasterCard, Amex, and Invoice payment. The currency depends on where the product(s) are being delivered/purchased to/from.
  • All prices on awakeboards.com are displayed without any taxes or local fees
  • There are two general payment options when purchasing electric surfboards from awakeboards.com

Option 1 – Order paid in full

  • The order is paid in full at check-out
  • The order is confirmed and sent digitally to Awake
  • The order is shipped from Awake’s manufacturing facilities in Poland,  either as soon as practically manageable considering the supply and/or production workload or in accordance with the client’s specific request
  • Any additional costs such as local fees and import tax are not included in the payment and must be settled with the respective local authorities when/before delivered/released from the specific country’s customs/declaration agency 

Option 2 – Pay by Invoice

  • The payment option is pay by Invoice 
  • The order is confirmed and sent digitally to Awake
  • When the Invoice is fully paid, we will prepare the shipment
  • The order is shipped from Awake’s manufacturing facilities in Poland, either as soon as practically manageable in terms of supply and/or production workload or in accordance with the client’s specific request.
  • Any additional costs such as local fees and import taxes are not included in the payment and must be settled with the respective local authorities when/before delivered/released from customs 

Europe (EU/EEC/EEA)

Orders within Europe will be handled by our Danish company, Ride Awake ApS. Orders are primarily shipped using road freight. Delivery takes approximately five to seven working days for Awake's electric surfboards and less for other products. 

  • Incoterms 2010: FCA
  • Currency for payments: € EURO

Rest of the world

Orders to countries not mentioned above will be shipped DAP (Delivered At Place) accordingly to Incoterms 2010. We do not collect VAT, duties, and/or taxes on orders and we cannot predict what your particular charges may be. If you do get such additional charges, they must be paid for your package to clear customs. Please contact your local customs office for more information. For these collections, it takes around fifteen working days for delivery. Other fees may be added depending on the country.

Shipping & Delivery

Shipping of Awake's electric surfboards

Awake will update the customer on the preliminary shipping date and send a notification when the electric jetboard is ready to be shipped.

Shipping zones – electric surfboards

Your shipping cost will be calculated at checkout, depending on your delivery address.

No delivery to post office boxes due to restrictions by courier services and credit card scam risks. Sending orders to multiple addresses requires placing an order for each address. No combination is possible, and there will be charges for every order. Extra duties and charges: Please see the ‘Payment & Prices’ section.

Delivery Schedule

Although Awake will try to deliver your electric surfboard or other product(s) as soon as reasonably practicable, you understand and agree that there may be delays. An estimated time of delivery (ETD) is only an estimate and is subject to change. Awake does not guarantee that it will be able to ship the electric surfboard or other product(s) by the estimated date. As a result, in the event that a delay arises and the estimated shipment and/or release of the electric surfboard is not met, Awake is not responsible for any damages that may occur due to the delay, nor shall it be obligated to provide any discounts, refunds or credits due to any such delays. Awake will provide you with periodical updates with information regarding the delivery schedule.

Cancellation period

You, as a buyer, have the right to cancel the order of an electric surfboard or other product(s) and be refunded in the same currency as paid by contacting sales@awakeboards.com within 14 (fourteen) days after the date of the confirmed order.

Registration

When paying for the electric jetboard, you will be required to provide certain information, such as your address and billing information. It is your responsibility that all such information is accurate, and you shall ensure that such information is kept current. Awake shall have no responsibility or liability for inaccurate information that later becomes outdated. Awake shall have no obligation to make efforts to determine the correct contact or shipping information. You can update your information at any time before your product being shipped by sending an e-mail to sales@awakeboards.com

Transport damages

Transport damages must be immediately reported by the recipient of the products to the carrier in writing, with a copy to Awake. Under no circumstances shall Awake be liable for any destruction, damage, loss or theft occurring during the transport of the products.

Passing of Title & Risks

Title to the products delivered shall not pass to the customer until the actual payment in full of the principal amount, interest and ancillary cost. Notwithstanding the title retention as set forth above, the risks pertaining to the delivery of products (including the risks of loss or destruction) shall pass, if no INCOTERM for the delivery has been expressly agreed on, at the time when Awake informs the customer in writing about the availability of the ordered products.

Uncollected product(s)

No refund of shipping costs for a failed collection of the product(s).

Disclaimer

There is a risk of colors and displayed errors on the website. Actual colors may vary. This is because every computer monitor has a different capability to display colors and that everyone sees these colors differently. We try to edit our photos to show the samples as life-like as possible, but please understand the actual color may vary slightly from your monitor. We cannot guarantee that the color you see accurately portrays the product's true color. All details, such as specifications and manufacturing brand, are subject to changes. Changed parts will always be an equal product as stated earlier. Lights such as the headlight, blinkers, and more are subject to change based on local regulations worldwide, which means that the lights shown in pictures might be different on delivered products. Written errors can occur from the human factor, third-party information, or broken integrations, codes, or automatic updates. Awake tries its best to display free-of-error texts, images, and stock, as well as prices for products, shipping in the site, and webshop. If your order would have an error such as the payment, product, quantities, don’t worry, please email us at sales@awakeboards.com to solve and adjust the error for all parties. Awake, doesn’t warranty uncertainties caused by these errors. Moreover, Awake cannot guarantee that all content is updated since they can be altered at any time.

Limitation of Liability

Our electric jetboards can be hazardous to operate and we care about your safety, so please note that;

  • All riders should ride well within the limits of their abilities, never beyond them.
  • Our electric surfboards are recommended for those aged 18 years and older
  • We recommend that all riders take a relevant training course
  • Make sure that you ride in a permitted area. Always follow your local regulations
  • Always wear a certified helmet, eye protection, and protective gear, including an approved floatation device
  • Never carry passengers, the electric surfboard is registered for only 1 rider
  • Never engage in stunt riding
  • Never ride in conjunction with alcohol or drugs. It is illegal and dangerous
  • Avoid excessive speed and be particularly careful on difficult terrain
  • Don’t modify your electric surfboard. All modifications and installations are at your own risk
  • Never change the voltage level or tamper with the battery. Doing so can result in a short circuit, fire, and/or personal injuries
  • By purchasing and/or riding our electric surfboards, you take full responsibility for any use, and/or misuse of the product and agree that Ride Awake ApS and any of their national and/or international subsidiaries holds no responsibility for any consequences, legal, or other, of such use and/or misuse
  • Read the user manual carefully, follow the instructions, and enjoy your Awake electric surfboard!

Returns & Exchanges

Awake does not accept returns or refunds of any products considered non-faulty, as the products provided by Awake are exclusively made to order. Any claims relating to an alleged defect of the products or in relation with the delivery of the products have to be made by the customer in writing for apparent defects within 14 days upon receipt of the products and for hidden defects within 14 days upon discovery, but in any case within the warranty period stated in clause 10. Returns will be accepted only if authorized beforehand by Awake, and may be repaired or exchanged at Awake’s sole discretion.

How to proceed with a request for return: Kindly contact sales@awakeboards.com for info on how to go through with the whole process of your return. State your order number. Furthermore, clarify which product(s) you are sending back, and state clearly why you wish to return the product(s) (the defect you've identified).


Steps

  1. Return of product(s) requires a return authorization (RA) number; without which there will be no acceptance of the returned product(s).
  2. To receive a return authorization, contact us via email using the information illustrated below: sales@awakeboards.com
  3. To return a package, you should inform us within a month from the day the package was received. Awake has no responsibility resulting from damage or loss of the product(s) since we recommend you ensure the product(s) via logistics and keep tracking number until the complete refund has been done.
  4. Returned product(s) should be in untouched condition with original tags placed on the package.
  5. The packaging of the manufacturer should be visible either in writing or marks.
  6. The customer is responsible for the return shipping costs, and other extra costs. Awake will only call for return when there was a shipment error in this case we cater for such expenses.

Commercial Warranty & Claims

1. Warranty coverage

1.1 This warranty applies to all Product(s) sold by Ride Awake or any authorized reseller, retailer, or partner confirmed by Ride Awake (collectively referred to as "Awake").

1.2 Awake guarantees that its Products will be free from defects caused by faulty materials or poor craftsmanship during normal use for the period specified in this document.

2. Warranty period

2.1 The warranty is valid for 24 months from the date of purchase, as indicated on the invoice.

2.2 The battery is covered under the standard 24-month warranty or up to 300 full charge cycles, whichever comes first. Damage due to improper use, overcharging, deep discharging, or exposure to extreme conditions is not covered under warranty.

2.3 If a part is replaced under an approved warranty claim, the replacement part will be covered as follows:

  • If the original product has 6 months or more remaining in its warranty period, the replaced part will inherit the remaining warranty of the original product.
  • If the original product has less than 6 months remaining, the replaced part will receive a minimum warranty of 6 months from the replacement date.

 

2.4 If Awake repairs a product, the repaired part will be covered as follows:

  • The product retains its original warranty period - the overall warranty duration does not reset or extend.
  • Repairs performed by Awake are covered by a 6-month guarantee on the repaired components, starting from the repair date.
  • The extended coverage applies only to the repaired components, not to the entire product.

 

2.5 This warranty policy is in addition to any applicable statutory guarantees and locally regulated consumer laws.

3. Warranty claim eligibility

3.1 The warranty is available to the original buyer who bought the Product(s) directly from Awake or an authorized Awake reseller.

3.2 Proof of purchase, such as an invoice or receipt, is required to verify ownership and confirm the warranty period.

3.3 The warranty is transferable to a new owner. Contact support@awakeboards.com with proof of purchase and ownership transfer details to transfer the warranty.

Note: The warranty period does not extend upon transfer; it remains based on the original purchase date.

4. How to make a claim

4.1 If you believe you have a warranty claim, contact Awake using the instructions below. Our team will guide you through the process, which may involve providing photos, videos, or other documentation to assess the issue.

4.2 Awake will determine claim validity in accordance with this policy. Our decision will be final.

4.3 If the warranty claim is approved and no exclusions apply, Awake will take one of the following actions at its discretion:

  • Repair the defective Product at no cost.
  • Cover the cost of repair by an authorized service provider.
  • Replace the defective Product or relevant part, free of charge and in the same quantity as was initially purchased.

4.4 Awake reserves the right to charge for reasonable delivery costs when supplying a replacement product unless prohibited by local law.

4.5 Customers are responsible for packaging and shipping costs when returning products for warranty service unless otherwise specified by local law.

4.6 Warranty coverage does not require product registration, but providing proof of purchase is mandatory.

4.7 If the original purchase was made through an authorized Awake reseller, the replacement Product will be shipped to that reseller’s operational location. The authorized Awake reseller is responsible for forwarding it to the customer.

Note: If a returned Product does not have a valid warranty claim, the customer must pay shipping costs to and from Awake before the Product is returned. Any necessary service work will only be performed upon customer approval and payment.

5. Warranty limitations

5.1 The warranty does not cover:

  • Damage caused by misuse, vandalism, interference, or neglect.
  • Damage from failure to follow Awake’s maintenance procedures, as outlined in the User manual.
  • Damage caused by using accessories or parts that are not manufactured, or otherwise approved by Awake.
  • Products where the seal has been broken or tampered with.
  • Damage to the carbon fiber hull.
  • Use of the Product outside its intended purpose.
  • Unauthorized repairs or modifications.
  • Personal injury, death, property damage, or financial loss, regardless of how it occurred.
  • Claims made more than two (2) months after the defect was discovered or should have been discovered.
  • Damage due to normal wear and tear, negligent use, extreme weather conditions, or unsafe locations.

 

5.2 Awake reserves the right to update Product specifications, manuals, and instructions at any time. Visit www.awakeboards.com for the latest information.

6. Local laws and regulations

6.1 This warranty policy does not exclude or restrict statutory guarantees that cannot be excluded under local laws. Awake will honor its obligations under those laws and regulations.

6.2 This warranty policy is in addition to any applicable statutory guarantees.

7.2 Required documents for warranty verification:

  • Proof of purchase (receipt or delivery confirmation).
  • Invoice number.
  • Customer name and address.
  • Purchaser’s email and phone number.
  • Description of the defect.
  • Any additional information reasonably required by Awake, including photos, videos, and other material relating to malfunctioning product(s).

 

Intellectual Property

Awake retains all rights to intellectual property and know-how related to the products sold by Awake. The customer undertakes not to reproduce or procure the reproduction of the trademarks, design rights, patents and any other industrial or intellectual property rights held by, or licensed to, Awake, in whole or in part. Awake has and shall retain full ownership and copyright of any studies, drawings, documents, designs, technical calculations, cost estimates, technical information provided to the customer concerning the products supplied thereto. Any such documents shall neither be reproduced nor disclosed or made available to any third party. If no order is placed, all such documents must be returned to Awake without delay.

No Liability – Force Majeure

Awake shall be released from any undertaking, in particular with regard to delivery periods: in the event that the customer has not complied with the payment terms; • in the event of force majeure or occurrences, such as: lockouts, strikes, epidemics, embargoes, accidents, rejection of principal parts being manufactured, interruption or delay in transport, disruption to supplies or any other event beyond the control of Awake occurring at the premises of Awake, its suppliers or subcontractors, including when resulting in layovers or short-time working.

Privacy Policy

Awake is responsible for personal data related to the services. However, other processors or co-responsible parties can act with personal data. “Personal Data” means any and all information, which can be directly or indirectly linked, to a living natural person. We strive to maintain a high level of protection of personal privacy. Awake uses personal data primarily to administer, provide, develop, and maintain the services, process your reservations, optimize your experience with respect to the services and individualize the communication with you. 


Please read this Privacy Policy carefully to understand how and for what purposes we process your Personal Data. By providing your Personal Data to us and accepting the applicable terms and conditions, you consent to your Personal Data being processed in accordance with the provisions set forth in the separate terms and conditions for each Service and this Privacy Policy. If more specific consent is required from you by law, we will of course ask you for such specific consent. This Privacy Policy together with Terms and Conditions, Awake’s Cookie Policy, and any other separate terms and conditions governing Awake’s processing of Personal Data from time to time are together referred to as the “Privacy Terms”.


The Privacy Terms state the basis for the manner in which we process Personal Data that you provide to us when you use the Services or that we collect regarding you. Thus, with respect to some of our Services, there are also separate terms and conditions for the processing of Personal Data that you accept when you use each Service.


We only collect Personal Data relevant for the purpose described in the separate terms and conditions for each Service and this Privacy Policy. The information we may collect is, for example, information regarding name, address, telephone number, email address, IP address, information to facilitate the use of the Services (such as a login), default language, user history, payments, and other information you provide when using the Services. Examples of Personal Data collected from companies outside Awake may include, updated address information, and demographic information.

 

Changes to this Privacy Policy are announced by the new terms and conditions being published on Awake’s websites and we, therefore, recommend that you regularly review these. If you add Personal Data regarding other people, you are responsible for ensuring that Awake may also process that Personal Data in accordance with the applicable Privacy Terms.

Collection & Processing of Personal Data

Awake collects and processes your Personal Data only where permitted by law. The collection and processing may take place when you use the services. We use various methods to collect Personal Data such as cookies, web beacons, customer surveys, and membership services. At various times, Awake compiles or imports Personal Data from databases (e.g. from Facebook or Google) within and outside Awake. From time to time we receive Personal Data regarding you from companies within Awake, cooperation partners, and other information that may be added to your profile (if a profile has been created). 


It is important for Awake to keep your Personal Data up to date and accurate at all times. That is why we may import Personal Data about you from external sources such as public registers. When the law requires that consent be obtained for the processing of certain types of Personal Data or for certain forms of processing, consent will be obtained from you before processing takes place. By proceeding to the checkout to buy an item the information typed in, in the checkout columns is saved as long as the information is useful for Awake or when the customer wants the information deleted. Useful cases are eg: abandoned shopping carts that occur because of technical issues, unexpected situations in the surroundings in conjunction when placing the order or when the customer has questions before the item(s) are bought and doesn’t find the answer. Therefore we will try our best to follow up and give the customer the best possible service to help them place an order if they’re interested.

Jurisdiction – Applicable Laws

The General Terms and Conditions of Sale and any supply of products thereunder are governed by Danish law. The provisions of the United Nations Convention on the International Sale of Goods shall not apply to this Agreement. All disputes arising out of or in connection with the General Terms and Conditions of Sale and any supply of products thereunder shall be submitted to the exclusive jurisdiction of the courts in Copenhagen, Denmark.
